Terms of Service

These Terms of Service ("Terms") govern your access to and use of https://nourishgreen.life (the "Site"), operated by Nourish Green LLC ("Nourish Green," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

Eligibility and Use of the Site

  • You must be at least 18 years old to use the Site.
  • The Site is intended for individuals located in the United States.
  • You agree to use the Site only for lawful purposes and not to misuse or attempt to disrupt its operation.
  • You agree to provide accurate, current, and complete information when placing orders or creating an account.

Products

  • Our products consist of fresh microgreens classified as raw agricultural products.
  • We do not make medical, nutritional, or health claims about our products.
  • All products are perishable and should be consumed promptly after fulfillment.

Orders and Pickup

  • All orders are fulfilled through subscription only. One-time orders are not currently available. Home delivery is not currently available.
  • Pickup is available at designated farmers markets or partner locations in Huntsville, Spring, and The Woodlands. Pickup locations and times are subject to change. You will be notified of changes that affect your active subscriptions.
  • You are responsible for retrieving your order during the designated pickup window. We are not responsible for orders not retrieved during the pickup window.
  • Pickup time windows are estimates and may vary slightly due to operational factors.

Accounts

  • An account is required to start a subscription.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts at our discretion.

Payments

  • All payments are processed securely through Stripe.
  • We do not store full payment card information on our servers.
  • Raw agricultural products are exempt from Texas sales tax.
  • Prices and availability are subject to change. We will notify you by email when changes affect active subscriptions.

Subscriptions and Saved Payment Methods

  • Subscriptions renew automatically unless canceled, paused, or skipped through your account page.
  • Each subscription is tied to a single pickup point. Subscriptions at different pickup points are managed separately.
  • We are a grow-to-order operation. When a subscription invoice is charged, that is when we begin growing your order. You pay before we start the grow.
  • Subscription items are grouped into invoices based on the grow-cycle lead time of each product. Products with the same lead time are billed on the same invoice; products with different lead times produce separate invoices.
  • By starting a subscription, you authorize us to charge your payment method automatically for each subscription invoice without requiring your presence at the time of each charge.
  • There are no pickup fees.
  • You may manage, pause, skip, or cancel subscriptions at any time through your account page or by contacting us. Pausing or canceling does not affect orders already placed and paid for.

Cancellations and Refunds

  • Due to the perishable nature of our products, all sales are final. No refunds are issued once an order has been placed.
  • In limited cases involving damaged or incorrect orders due to our error, we may issue a credit at our discretion if reported promptly.

Intellectual Property

All content on the Site, including text, images, logos, and design elements, is owned by Nourish Green LLC or its licensors and may not be used without prior written permission.

Disclaimer of Warranties

The Site and all products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability or fitness for a particular purpose.

Limitation of Liability

To the fullest extent permitted by law, Nourish Green LLC shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to the use of the Site or our products, including delays or interruptions beyond our control.

Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Walker County, Texas.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
